Tree Liability in the South has been established in response to the growing demand for arboricultural
reports relating to public liability and subsidence in particular. Our aim is to simplify the focus on data collection,
analytic reports and mapping of trees, much of which in our opinion, is unnecessary in situations where a landowner acknowledges
the fact that the trees on his/her property may be a risk to the public and as a response
contracts an arboriculturalist. Costs are an issue and tree survey costs add
to an overstretched budget. We aim to approach tree health surveys from a legal stance, that of seeking to focus on the landowner
as a defendant seeking to mitigate the steps taken to acknowledge what is known in law as a ‘duty of care’. Also
to acknowledge the breadth of that responsibility and take precautionary steps to ensure that the trees on the land are
safe to those who are in the proximity or in the neighbourhood.
As a consultancy practice we offer a variety of services predominantly to cover liability
whether that is for prospective purchasers of houses with trees close by, to those seeking insurance cover when there are
trees on their land or involvement when trees have caused damage and expert witness reports are required to enable clients
to mitigate their liability.
We also map out sites for species of wildlife and habitats and identify opportunities for
habitat retention, restoration, enhancement and creation, in other words environmental and conservation ecological surveys.
Our qualified staff in arboriculture, ecology, law, structural engineering and electronics
and currently work closely with a variety of agencies across the sectors using our specialist knowledge to co-ordinate projects.
